Medical Experts
The law requires that testimony from a medical expert is necessary
to prove: (a) the establishment of the acceptable standard of care
that the negligent medical provider should have performed; (b) the
medical provider's deviation from the acceptable standard of care
(negligence) and (c) the resulting damages (the causation). Ideally,
the medical expert who provides this crucial testimony is a medical
provider from the same field of practice or medical specialty as the
defendant medical provider, and has considerable education,
training and experience in that specialty.

At Gorovitz & Borten, we use our best efforts to identify and retain
appropriate medical experts (and in many cases, there will be
several medical experts being retained) as early as possible in the
litigation process. This enables us to have the benefit of their
considerable expertise and experience during the critical phases of
discovery (when interrogatories are asked and depositions of the
defendant medical providers and key witnesses are taken), as well
