The law requires that testimony from a medical expert is necessary to prove: (a) the establishment of the acceptable standard of care that the negligent medical provider should have performed; (b) the medical provider's deviation from the acceptable standard of care (negligence) and (c) the resulting damages (the causation). Ideally, the medical expert who provides this crucial testimony is a medical provider from the same field of practice or medical specialty as the defendant medical provider, and has considerable education, training and experience in that specialty.
